Information on the processing of personal data

Pursuant to Articles 12 and 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC ("GDPR"), we wish to inform you of the following.

  • the performance of the professional task conferred;

  • the fulfilment of further related legal obligations, including those of a fiscal nature.

The legal basis of the processing is:

  • for the purposes referred to in point (a), its necessity for the purposes of implementing pre-contractual measures adopted at the request of the data subject pursuant to Art. 6(1)(b) GDPR or, in any event, for the purposes of fulfilling legal obligations incumbent on the data controller pursuant to Art. 6(1)(c) GDPR;
  • for the purposes referred to in (b) above, its necessity for the performance of a contract to which the data subject is a party, pursuant to Article 6(1)(b) GDPR;
  • for the purposes set out under (c) and (d), the necessity thereof for the fulfilment of legal obligations incumbent on the holder, pursuant to Article 6(1)(c) GDPR.

In the performance of the professional task conferred upon you or, in any event, for the purposes indicated above, it may be necessary to process personal data that may reveal your origin, political opinions, religious or philosophical beliefs or trade union membership, as well as genetic data, biometric data intended to uniquely identify you, data concerning your health, sex life or sexual orientation. In this case, the legal basis for the processing will be represented by your explicit consent to the processing of the data in question, for the specific purposes indicated above, pursuant to Art. 9, paragraph 2, letter a) GDPR, unless it is personal data that you have manifestly made public, as such processable under the further legal basis provided for by Art. 9, paragraph 2, letter e) GDPR.   1. Target audience

For the purposes referred to in point 2 above, the personal data provided by you may be communicated, as appropriate, to judicial offices, Alternative Dispute Resolution bodies, other lawyers or professionals involved in the performance of the professional task you have conferred, third party suppliers of goods or services functional to the performance of the task itself, public administrations and public bodies, any counterparties and their lawyers. The personal data you provide may also be processed on behalf of the controller by data processors within the meaning of Article 28 GDPR, as well as by persons acting under the authority of the controller or processor within the meaning of Article 29 GDPR, duly instructed to do so.

  1. Transfer of data to third countries or international organisations

There is no intention to transfer your personal data to states that are not members of the European Union, nor to international organisations. Should one or the other eventuality become necessary for the purposes set out in point 2 above, this information will be supplemented accordingly in accordance with Article 13, paragraph 1, letter f) and paragraph 3 GDPR.

  1. Conservation period

The personal data provided by you will be kept in a form which permits identification of the data subject for the period of time necessary not exceeding the achievement of the processing purposes referred to in point 2 above.

  1. Rights of the data subject

As a data subject, you have the right to request from the controller, pursuant to Article 15 et seq. of the GDPR, access to, rectification and erasure of, and restriction of, personal data concerning you, as well as the right to object to such processing and the right to the portability of such data. As a data subject, you also have the right to lodge a complaint with a supervisory authority in the Member State where you usually reside or work, or in the Member State of the alleged breach.

  1. Processing based on the consent of the data subject and its withdrawal

Whenever the legal basis for the processing is the consent of the data subject pursuant to Article 6(2)(a) GDPR or pursuant to Article 9(2)(a) GDPR, such consent may be withdrawn at any time, without prejudice to the lawfulness of the processing based on the consent given before the withdrawal.

  1. Need to provide data and consequences of failure to do so

The communication of your personal data and their processing for the purposes referred to in point (2) above by the data controller are necessary for the purposes of conferring the professional task, its execution and the fulfilment of the related legal obligations. The communication of such data by you is also subject to specific contractual obligations, with reference to the data processed for the purposes referred to in letter (b) of point 2 above, and to specific legal obligations, with reference to the data processed for the purposes referred to in letters (c) and (d) of the same point 2.

Failure to provide the data in question may make it impossible for the data controller to accept the professional assignment, to execute it or to comply with the related legal provisions.

  1. Automated decision-making processes

The personal data you provide will not be subject to any automated decision-making process.
